At a glance

We only process personal data where this is necessary to run this website, to answer your enquiry, to send our newsletter or for our work as an agency. We do not use third-party analytics or advertising services, we do not set any cookies and we do not embed content from social media platforms.

Hosting and server log files

Our website and our email inbox are hosted by IONOS SE, Elgendorfer Straße 57, 56410 Montabaur, Germany. IONOS processes data on our behalf under Art. 28 GDPR on servers within the European Union.

Each time you visit, your browser transmits technical information such as the page requested, date and time, browser type and version, operating system, device type and the referring page. IONOS stores this information in server log files, with the IP address in anonymised form only. The log files are deleted after eight weeks. We need this data to keep the website secure and stable. The legal basis is our legitimate interest under Art. 6(1)(f) GDPR.

Encryption

This website uses SSL/TLS encryption. You can recognise an encrypted connection by “https” in your browser’s address bar.

Cookies

This website does not set any cookies and does not store anything else on your device. The language you see is determined solely by the page address.

Fonts

The fonts used on this website are hosted on our own server. No connection to Google or any other font provider is made when our pages load.

Contact form and email

When you contact us via the contact form, by email or by phone, we process the information you give us. In the form, this is your name, your company, your email address, your phone number if you choose to add it and your message. The form sends your details to us by email; they are not stored on the website itself.

We use this data to answer your enquiry and to prepare a possible project with you. The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to a contract, otherwise our legitimate interest in responding under Art. 6(1)(f) GDPR. We delete your enquiry once it has been dealt with, unless statutory retention obligations apply.

In our newsletter we share news about new artists, current projects and the industry from time to time. All we need to sign you up is your email address.

We use the double opt-in procedure. After signing up, you receive an email with a link to confirm that you really want to receive the newsletter. Only then is your subscription active. To be able to prove your consent, we store the time and IP address of your sign-up and confirmation.

We use the WordPress plugin MailPoet for sign-up, management and sending. It runs on our own website, so your data stays with our host IONOS and is not passed on to the maker of MailPoet. We send the emails via our own server. We do not track whether you open our emails or click on links in them.

The legal basis is your consent under Art. 6(1)(a) GDPR. You can withdraw it at any time via the unsubscribe link in every newsletter or by sending us a short message. We will then remove you from the mailing list. Where necessary, we keep your email address on a block list so that you receive no further newsletters. This is based on our legitimate interest under Art. 6(1)(f) GDPR.

Applications from artists

When artists apply to us, we process the information they send, such as name, contact details, portfolio and work samples, in order to assess a possible collaboration. The legal basis is Art. 6(1)(b) GDPR. If no collaboration results, we delete the documents no later than six months after our decision, unless the person agrees to longer storage.

Clients and assignments

To place artists and manage productions, we process contact, contract, billing and communication data of our clients and the artists involved. The legal basis is Art. 6(1)(b) and (c) GDPR. We store this data for the duration of the collaboration and afterwards for as long as commercial and tax retention periods require, generally up to ten years.

Links to Instagram

Our website links to the Instagram profiles of Charlie Ksiazek and Sarah Lucia Rabel and to individual posts. These are plain links; Instagram is not embedded. Only when you click a link are you taken to Instagram, a service of Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland, where the Instagram Privacy Policy applies.

Recipients

We only pass on your data where this is necessary for the purposes described, where you have consented or where we are legally obliged to do so. Recipients are our host IONOS as a processor and, within an assignment, the clients and artists involved. No data is transferred to countries outside the European Union.

Your rights

You have the right to access the data we hold about you (Art. 15 GDPR), to rectification (Art. 16 GDPR), to erasure (Art. 17 GDPR), to restriction of processing (Art. 18 GDPR) and to data portability (Art. 20 GDPR). You can withdraw any consent at any time with effect for the future (Art. 7(3) GDPR). A short message to info@thebeautypool.de is enough.

Right to object

Where we process data on the basis of our legitimate interest under Art. 6(1)(f) GDPR, you may object at any time on grounds relating to your particular situation (Art. 21 GDPR). We will then stop processing the data unless we can demonstrate compelling legitimate grounds.

Right to lodge a complaint

You can lodge a complaint with a data protection supervisory authority. The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information Baden-Württemberg, Lautenschlagerstraße 20, 70173 Stuttgart, Germany, www.baden-wuerttemberg.datenschutz.de.
